1. Acceptance of Terms
By accessing or using the website at seamind.xyz (the “Site”) and the Seamind maritime learning platform (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site or Platform.
Seamind LLC (“Company,” “we,” “our,” or “us”) reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Site or Platform after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
Seamind is an AI-powered maritime intelligence platform for crew development, crew management, and fleet operations. Depending on the products your organization has enabled, the Platform provides:
- Interactive, scenario-driven training modules for maritime compliance
- An AI tutor that answers questions and explains maritime regulations
- Quizzes and assessments to evaluate comprehension
- xAPI-based learning activity tracking
- Crew management, including crew profiles, identity-document and professional-certificate management, and office verification and approval workflows
- Fleet and vessel management
- Fleet-wide analytics and compliance reporting for organizations
3. User Accounts
Access to the Platform requires an authenticated account. Accounts are provisioned through your organization and managed via our authentication provider. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and current information
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that are inactive, in violation of these Terms, or at the request of your organization.
4. Acceptable Use
You agree to use the Site and Platform only for lawful purposes. You shall not:
- Use the Platform for any purpose other than maritime training and education
- Attempt to circumvent rate limits, authentication, or security measures
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Scrape, harvest, or collect data from the Platform through automated means
- Share your account credentials with others or allow unauthorized access
- Submit false, misleading, or harmful content through the AI chat or contact forms
- Use the Platform in a manner that could damage, disable, or impair the service
5. Training Content and AI Features
Training content: All training modules, course materials, quizzes, and related content on the Platform are provided for educational purposes. While we strive to align content with current maritime regulations including STCW, ISM Code, and MARPOL, the Platform is a supplement to — not a replacement for — formal maritime training, certification programs, and on-the-job experience.
AI features:The AI tutor, learning insights, and AI-assisted search over training content and your organization's documents are generated using artificial intelligence and are intended as educational and productivity aids. AI-generated responses and search results may not always be accurate or complete. You should verify critical regulatory information through official sources and qualified maritime professionals, and verify credential details against the underlying documents. We do not guarantee the accuracy, completeness, or timeliness of AI-generated content.
6. Intellectual Property
All content, features, and functionality of the Site and Platform — including text, graphics, logos, course materials, software, and AI-generated content — are the property of Seamind LLC or its licensors and are protected by intellectual property laws.
Your organization's subscription grants a limited, non-exclusive, non-transferable license to access and use the Platform for internal training purposes. You may not:
- Copy, modify, or distribute course content outside your organization
- Use our trademarks, logos, or branding without written permission
- Create derivative works based on Platform content
- Resell or sublicense access to the Platform
7. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Platform, you consent to the data practices described in our Privacy Policy.
Training activity data collected through the Platform (including xAPI statements, quiz results, and completion records) is owned by your organization and may be accessed by authorized administrators within your organization for compliance reporting and fleet management purposes.
Crew and professional profile data submitted to the Platform — including identity documents, professional certificates, employment and sea-service history, and next-of-kin details — is provided and controlled by your organization, and we process it on your organization's behalf. Authorized administrators within your organization may access, review, verify, and manage this data for crew management, compliance, and fleet operations. Individual users may view and update their own profile data as permitted by their organization. On offboarding of a user or termination of your organization's subscription, this data is deleted, returned, or retained in accordance with our Privacy Policy and our agreement with your organization, except for records we are legally required to keep.
8. Service Availability
We strive to maintain the availability of the Platform but do not guarantee uninterrupted or error-free service. The Platform may be unavailable due to:
- Scheduled maintenance or updates
- Circumstances beyond our control, including network or infrastructure issues
- Force majeure events
The Platform is designed to be resilient to intermittent connectivity at sea. If a connection drops during training, a crew member can resume where they left off once connectivity returns. Synchronization of progress and content occurs when bandwidth is available and is provided on a best-effort basis.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Seamind LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Platform, including but not limited to:
- Loss of data or training records
- Errors or omissions in training content or AI-generated responses
- Service interruptions or downtime
- Decisions made based on Platform content
- Failure to pass maritime certifications, inspections, or audits
Our total liability for any claims arising from use of the Platform shall not exceed the amount paid by your organization for the Platform in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Seamind LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site or Platform or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Platform at any time if you violate these Terms or at the request of your organization. Upon termination:
- Your right to access the Platform ceases immediately
- Your organization may request export of its data in accordance with our data retention policies
- We delete or return personal data we hold on your organization's behalf, except for records we are legally required to retain (including training records required by maritime compliance regulations). Personal data contained in routine backups ages out on its normal backup cycle, as described in our Privacy Policy.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
